Tucson, AZ - Harris Environmental recommends
proceeding with Cactus Ferruginous Pygmy-Owl (CFPO) surveys despite
recent discussion of delisting the species because the owl is still
listed and will be through mid-May, at a minimum. Environmental groups
have filed a petition to emergency list pygmy-owl (and possibly not as a
Arizona Distinct Population Segment [DPS] but as a western DPS or a
subspecies) and designate critical habitat soon. The relist petition
will be independent of the delist process. The latter may result in a
period where no surveys are required for permitted activities, or/and
where the delist/relist rulings are in litigation limbo. Surveys
conducted during the limbo period contribute more presence/absence
information than no surveys and may contribute to an expedited project
clearance.
